The products pose a risk of choking and injuries because the product can easily be confused with a foodstuff and thus constitute a choking risk, particularly for children. The risk is aggravated by the small size of the articles (the samples fit into the small parts cylinder used for toy testing in accordance with the standards) and the presence of magnets that can easily be detached and, because they attract each other, can cause serious damage when passing through the intestine (blockages, perforation of the intestine). The products do not comply with the Directive 87/357/EEC on products which, appearing to be other than they are, endanger the health or safety of consumers.

Product description
1. The package is made of clear cellophane tied shut at one end with a gold cord to which the label is attached, and contains a sheet of white paper with perforated edges on which are arranged nine pale pink or cream-coloured chocolates. On the base of each chocolate, there is a circular magnet 0.6 cm in diameter and 0.3 cm thick. There are two labels on each package. 2. The cardboard packaging contains four chocolates, each one within a compartment of another plastic container. Each chocolate is also contained in a cup made of white fluted paper. Two of them are shaped like round flowers with five petals. One is pale pink and the other chocolate-coloured, decorated with wavy lines on top, heart-shaped with a white border and a yellow and red decoration in the middle. All of the chocolates have a cream-coloured base to which is attached a round magnet 1.8 cm in diameter and 0.3 cm thick.
